MADISON, N. J. — A man has been arrested in Miami and charged with dealing in Viagra and making an illegal steroid use, according to police.
Tina Alves, 48, of Miami, pleaded guilty on Monday to one count of dealing in Viagra and making an illegal steroid use, according to his lawyer, Mark C. Foulston.
The arrest came after Alves’s attorney, John J. Foulston, said the drug could have been used to treat erectile dysfunction and had not been shown to increase the risk of developing prostate cancer.
“The defendant’s conduct could have caused a dangerous result for the defendant,” Foulston said in a news release.
The defendant was charged with two counts of dealing in Viagra, and one count of making an illegal steroid use.
The charges, which were filed in U. S. District Court in Miami, were set for a hearing on Nov. 15.
“This matter has been discussed with the parties and the judge. We are aware of the nature of this case and have spoken with the parties,” Foulston said in a news release.
Foulston said he was “unwilling to represent the defendants in this matter.”
The case is being prosecuted by Assistant United States Attorney Jessica L. Cushnick and United States Attorney Charles C. Stuber, according to the release.
Foulston said the defendant faces up to 20 years in prison and $250,000 in costs.
Alves faces three years in prison, and $25,000 in costs. Cushnick said the defendant has used Viagra since 1999.
“This case demonstrates that a defendant faces a serious criminal liability, and we will continue to work with the government to find an alternate, more appropriate use of drugs for the benefit of individuals,” Cushnick said in the release.
Cushnick also said he will not represent the defendant in any further proceedings in the case, which are not yet known.
“It is important to us that the defendant is properly warned about the risks associated with using the drug, and the consequences of using it are not known,” Cushnick said in the release.
The trial in Miami is set for Oct. 16-17, at 7 p.m. in the Miami Herald Building.

The case was investigated by U. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations’ (HSI) Operation Reach for an Active Member Team, and the Food and Drug Administration’s (FDA’s) Office of Criminal Investigations.
An HSI investigation revealed that the defendant made an illegal steroid use in 1999 while on a steroid medication, which could have caused dangerous side effects, including an increased risk of prostate cancer, which could result in death.
The drugs were purchased by Alves and another patient, who said he was taking an illegal steroid product for several years. The drug was then used to treat erectile dysfunction, Alves said.
The drug was discovered in the bloodstream of Alves when he was found to have an allergy to the steroid, the HSI report stated.
The steroid product was later identified and Alves had a prescription for the steroid, which would have made it more difficult for Alves to use the drug, the report said.
The drug was sold by Alves to another patient, who said he had not had a chance to use the steroid product. The patient had previously been using Viagra and was taking an illegal steroid product, the report said.
